prop 8 in california. if that is struck down, does that mean marriage equality then for all intents and purposes is legal in all states? does what happens in california then change the relevance for 49 other states? >> well, this all gets to how the supreme court rules. you know, i think it was the ninth circuit -- the ninth circuit court of appeals when they upheld the decision written by judge vaughn walker. judge vaughn walker didn't go for the big expansive constitutional right to marry that ted olson and david boies was hoping he would go for. he had a very narrow ruling. will the supreme court stick to that narrow ruling? if they do, same-sex marriage, assuming prop 8 is knocked down, then same-sex marriage could just be limited to california. and what we could end up have happening is a situation where you have something like 20% of the country where same-sex marriage is legal and if richard is right and doma is struck down as unconstitutional where you could have legally married same-sex couples in, say, california or new york who are then able to avail themselves of the 1,1

california, michael bloomberg is from new york city. a lot of the calls for gun control legislation in this country are coming from folks who are in urban areas, talk to me a little bit about to the difficulty in the past, the difficulty that you have had convincing some lawmakers in rural parts of this country, to take up your cause. >> well, i want to talk about some of the agreement first. because the american people agree on this issue much more than our leaders in congress. i mean 74% of nra members and gun owners support having background checks for all gun sales. right now, only 40 -- sorry, 60% of gun sales take place with a background check. so we have huge disagreement there among gun owners, nongun owners, blue states, red states, we need to see that sort of agreement on capitol hill. the people are there, we need to follow the will of the people. >> i do think sometimes there's a tremendous chasm on how guns are viewed in places like chicago, new york and california, how they're viewed in versus how they're viewed in places like i'm from in south carolina, or in rural pl

would hear a case on the constitution nality of the defensive marriage act as well as california's anti-same-sex proposition 8. as pete williams tells us now, we'll have to wait a little longer. >> craig, it was quite an anti-climax friday. waiting all day expecting we'd hear something from the supreme court on what they would take and an order's list that had just two cases on that had to do with patents and pan patenting n genes. it's impossible to know for sure. quite likely that the justices want more time to discuss these cases. so, they'll reschedule this for perhaps their next closed door conference which is this coming friday. that sometimes happens. the voting rights act case, for example, which was granted earlier in november. they put on several successive lists before they finally decided to grant it. so, that's one possibility. it's also possible that they're not going to take some of these cases. but on friday, all the supreme court announces is cases that it will grant, not cases it will deny. we'll get the denials list that's ready this coming monday. so, that will be th

, piling on california lawmaker, from that state? pinches i think we have to take up all the issues. they mass killings have to stop and we have to do everything we can. it will include looking at how many bullets do you need in a magazine in a semiautomatic weapon? i don't know, but i'd like all the hunters to come to the table as well as the people who live in cities who do not want guns and want gun controls. we had need a real dialogue, not just a one-sided one. we need to talk about xbox 360, wii, and the games, how far down into children they're getting. we need to talk about movies. we need to talk about the rating sims, what's in pg and pg-13 are pretty violent. i think we just have a culture we need to address in its totality if we're going to take people who are clearly mentally ill and try to give them help earlier. i thought charles crowdhammer, who is a psychiatrist, had a point, where it's harder to commit someone for treatment today because it does interfere with certain privacy rights, but yet here we have this is nutty people with huge firearms and a culture that de
